New Verdicts in NEC (necrotizing enterocolitis) Cases Show Promise for Future Litigation
Recently, a St. Louis, MO jury awarded the family of an Illinois girl a $495 Million verdict. The lawsuit claimed Abbott Laboratories failed to warn their baby formula could cause NEC, which is a potentially fatal disease affecting premature infants.
This verdict sheds light on the serious consequences of some baby formulas and highlights the need for manufacturers to provide adequate warnings. This verdict sets a strong precedent for other NEC cases. This is the second landmark verdict this year, with a jury awarding $60 Million in St. Clair, IL in March.
There are thousands of NEC lawsuits filed throughout the country, some in state court and others in an MDL (multi-district litigation). The powerful message to manufacturers is they need to focus on product safety and transparency. These verdicts may prompt settlement for some pending state court lawsuits and have an impact on the first bell whether trial for the MDL, scheduled in May of 2025.
